Fact Summary

In October 2004, the defendant contacted the victims through an employment agency, “La Preferida”, located in the city of Tacna, Peru.  The defendant offered them waitress jobs at her residence, “Tajibo”, for a monthly salary of CLP500 (USD1). She also gave them the necessary assistance to cross the borders by accompanying them and paying any travel costs.  The victims were then harboured at the accused’s residence where they were forced to provide sexual services to clients arranged by the accused.  Upon the victims’ arrival, the defendant also withheld their passports to prevent them from leaving prior to the repayment of their debts.  There was later testimony that she threatened the victims such that were available to provide sexual services at any time.

En octubre de 2004, la acusada entró en contacto con las víctimas a través de una agencia de empleo llamado "La Preferida", ubicada en la ciudad de Tacna (Perú). La acusada les ofreció puestos de trabajo de camarera en su residencial llamado "Tajibo" con un sueldo mensual de $ 500. También les dio el apoyo necesario para cruzar la frontera, como acompañantes, pagando todos los gastos de viaje, o que les daba refugio en la residencia del acusado, que era el mismo lugar donde las víctimas fueron forzadas a tener relaciones sexuales con los clientes.

A la llegada de las víctimas, la acusada retuvo los pasaportes de las víctimas para asegurarse que pagarían el dinero gastado por la espalda.

Varios testimonios (entre ellos algunos testimonios de los oficiales de policía), se confirmó que la acusada era el dueña de la residencial llamado "Tajibo", obligó a las chicas a prostituirse en este establecimiento, y se los mantiene bajo amenazas y órdenes para ser totalmente sexualmente disponible para todos los clientes potenciales.

Oral Criminal Court (Tribunal de Juicio Oral en lo Penal), Iquique, 10 October 2006, convicted and sentenced.

In coming to its decision the Court analysed 14 affidavits and a range of documentary evidence found at the defendant’s establishment (for example, passenger lists from a transportation company; contracts from the “La Preferida” employment agency indicating the provision of “escort services”; a folder with a list of names, phone numbers, dates, records of monies paid; and a pornography film).

 

The Court concluded that based on the evidence the accused had facilitated the entry of foreigners to Chile.  It was also held that the accused had acted fraudulently and subjected the victims to a system of sexual exploitation constituting the crime of trafficking in persons as defined in the Penal Code (Chile).

 

The accused was sentenced to a term of six years imprisonment and fined five “monthly tax units”.  He was also permanently disqualified from holding any official or public position.

Después de haber analizado 14 declaraciones juradas presentadas por los fiscales y la evidencia documental encontrado en el establecimiento del demandado (por ejemplo, lista de pasajeros de una compañía de transporte, varias copias del Contrato de la Agencia de Empleo denominado "La Preferida", que indica la prestación de servicios como "servicios de acompañantes los servicios ", una carpeta con una lista de nombres, números de teléfonos, fechas, cantidad de dinero pagada y una película de pornografía), el Tribunal concluyó que quedó demostrado que la acusada facilitó la entrada de extranjeros a Chile. La Corte también sostuvo que la acusada actuaba a través de fraude y se somete a las víctimas de un sistema de explotación sexual que constituya el delito de la trata de personas tal como se definen en el Código Penal de Chile.
El tribunal impuso la pena de 6 años de prisión a la acusada, así como la multa de 5 Unidades Tributarias Mensuales y la inhabilitación perpetua y absoluta de la posición oficial y pública.
