
At the end of September 2013, Defendant Kuzenko, in coordination with others, promised victims A. U. and S. B. to send them to Almaty, Kazakhstan, and organize for them employment as waitresses. Also knowing that the two victims are under-aged, through deception, Defendant Kuzenko transferred the two victims illegally over the border with Kazakhstan, where he earned 300 US Dollars for his criminal activities. The two victims were held in Kazakhstan with the intention to sexually exploit them.
Defendant Kuzenko pleaded guilty by arguing that the two victims asked themselves to work in prostitution, adding that he has not sold them to anyone and that no one was holding them captive in Kazakhstan. This account was not mirrored by the testimonies of the two victims, who argued that they were deceived by Defendant Kuzenko and were held against their will.
Furthermore, the individual who held the two victims captive in Kazakhstan had taken away their passports and forced them to work in prostitution. Only with the random meeting of an acquaintance who offered help, could the two victims flee and return to Uzbekistan. The court hearing has established, through the extensive gathering of evidence, that the testimonies of the two victims reflect the truth of events more closely than that of Defendant Kuzenko.

The Court concludes Defendant Kuzenko as guilty and sentenced under Article 135, Part 3, (a), and Article 223, Part 2, (b), of the Criminal Code of the Republic of Uzbekistan, for the illegal crossing of a state border, trafficking in human beings, their transfer, with the intention to exploit, of under-aged individuals, as well as the illegal holding in captivity of those individuals abroad.
