Section 105
Blackmailing constitutional organs
(1) Whoever unlawfully uses force or threats of force to compel
1. a legislative body of the Federation or one of the Länder or one of its committees,
2. the Federal Convention or one of its committees or
3. the Federal Government, the Federal Constitutional Court, or the government or constitutional court of one of the Länder not to exercise its functions or to exercise them in a particular manner incurs a penalty of imprisonment for a term of between one year and 10 years.
(2) In less serious cases, the penalty is imprisonment for a term of between six months and five years.
Section 106
Blackmailing the President of the Federation and members of constitutional organs
(1) Whoever unlawfully uses force or a threat of serious harm to compel 1. the Federal President or 2. a member of
a) a legislative body of the Federation or of one of the Länder,
b) the Federal Convention or
c) the Federal Government or Federal Constitutional Court, or the government or constitutional court of one of the Länder not to exercise their functions or to exercise them in a particular manner incurs a penalty of imprisonment for a term of between three months and five years.
(2) The attempt is punishable.
(3) In especially serious cases, the penalty is imprisonment for a term of between one year and 10 years.
§ 105 StGB
(1) Wer 1.ein Gesetzgebungsorgan des Bundes oder eines Landes oder einen seiner Ausschüsse, 2.die Bundesversammlung oder einen ihrer Ausschüsse oder 3.die Regierung oder das Verfassungsgericht des Bundes oder eines Landes rechtswidrig mit Gewalt oder durch Drohung mit Gewalt nötigt, ihre Befugnisse nicht oder in einem bestimmten Sinne auszuüben, wird mit Freiheitsstrafe von einem Jahr bis zu zehn Jahren bestraft. (2) In minder schweren Fällen ist die Strafe Freiheitsstrafe von sechs Monaten bis zu fünf Jahren.
§ 106 StGB
(1) Wer 1.den Bundespräsidenten oder 2.ein Mitglied a) eines Gesetzgebungsorgans des Bundes oder eines Landes, b) der Bundesversammlung oder c) der Regierung oder des Verfassungsgerichts des Bundes oder eines Landes rechtswidrig mit Gewalt oder durch Drohung mit einem empfindlichen Übel nötigt, seine Befugnisse nicht oder in einem bestimmten Sinne auszuüben, wird mit Freiheitsstrafe von drei Monaten bis zu fünf Jahren bestraft. (2) Der Versuch ist strafbar. (3) In besonders schweren Fällen ist die Strafe Freiheitsstrafe von einem Jahr bis zu zehn Jahren.
