R. v. B.R.

موجز لوقائع القضية

B.R. was a police officer with the Montreal Police Service from 1985 until his retirement in 2013. In 1990, he started worked as a criminal intelligence investigator where he developed an expertise in the collection and analysis of information related to criminal gangs. However, B.R. began selling this information to organized crime figures and groups.
On 14 September 2013, René Charlebois (a member of Hell’s Angels) escaped from prison where he was serving a life sentence for the murder of a police informant. Charlebois committed suicide on 25 September 2013; however, he had left behind a series of recordings from phone calls between himself and B.R.. Charlebois’ friend gave the recordings to the police, which first brought to light B.R.’s criminal activity.
The recordings revealed that B.R. had sold and disclosed confidential information to Charlebois. The recordings demonstrated that:
-B.R. had sold information regarding three police informants,
-B.R. had warned Charlebois of a police operation (the Loquace Project) concerning an extensive investigation into cocaine trafficking which allowed some individuals to escape arrest,
-B.R. had informed Charlebois of two further ongoing police investigations targeting drug trafficking and the Hell’s Angels, including disclosing information about the identities of suspects in an organized crime investigation concerning conspiracy to commit murder and drug trafficking
-B.R. had discussed the psychological state of a witness (justice collaborator) who was going to testify in court.
B.R. was paid approximately $125 000 CAD for this information.
B.R. learned of the existence of the recordings and was eager to recover them, unaware that the recordings were already in the possession of the police. An undercover officer contacted B.R. offering to sell the recordings to him for $50 000 CAD with an initial deposit of $10 000 CAD (the recordings would be handed over after the deposit was made), which B.R. accepted. They agreed on a location where the exchange would occur. During this attempted exchange, B.R. was arrested. Upon arrest, police found an additional $11 000 CAD in his car.
B.R. pleaded guilty to two of the counts laid against him: 1) participating/contributing to an activity of a criminal organization for the purpose of increasing the ability of the organization to facilitate or commit an indictable offence and 2) breach of trust (as a public servant). On 4 April 2014, he was sentenced to 8 years’ imprisonment (reduced to 7 years 3 months due to time served in pre-trial detention). B.R. was reportedly granted full parole in May 2017.
B. R. était un officier de police ayant servi dans la Police de Montréal de 1985 jusqu'à sa retraite en 2013. En 1990 il a commencé à travailler en tant qu’enquêteur de renseignements criminels où il a développé une expertise dans la collecte et l’analyse d’information relative aux gangs criminels. Cependant, B.R. a commencé à vendre cette information à des figures/personnalités et à des groupes du crime organisé.
Le 14 septembre 2013, René Charlebois (un membre des Hell’s Angels) s’est échappé de la prison où il purgeait une peine à vie pour le meurtre d’un informateur de la police. Charlebois s’est suicidé le 25 septembre 2013 ; cependant, il a laissé derrière lui une série d’enregistrements d’appels téléphoniques entre lui et B.R.. Un ami de Charlebois a donné les enregistrements à la police, ce qui a mis pour la première fois en lumière son activité criminelle.
Les enregistrements ont révélé que l'accusé avait aussi fourni et vendu des informations confidentielles sur deux enquêtes en cours relatives au trafic de drogue et concernant l'organisation criminelle des Hell's Angels, notamment les identités des suspects et les techniques d'enquêtes utilisées, mais également les identités des suspects dans une enquête criminelle concernant une conspiration en vue de commettre un meurtre. De plus, il aurait divulgué des informations sur une vaste opération policière (le projet Loquace) relative à l'importation de la cocaïne. Sa conjointe travaillait sur le projet et les informations qu’il a fourni à Charlebois ont permis à plusieurs individus de s’échapper et d’éviter d’être arrêté (l’un des individus en question était la tête dirigeante du réseau). B.R. a également fourni des informations sur trois informateurs de la police, et il a discuté avec Charlebois de l’état psychologique d’un témoin (collaborateur de la justice) qui allait témoigner devant la cour. B.R. a été payé environ 125.000$ CAD pour ces informations.
Lorsque B.R. a appris l’existence de ces enregistrements il a cherché à les récupérer en raison de leur caractère compromettant, sans savoir qu’ils étaient déjà en possession de la police. Cette dernière a donc procédé à une infiltration qui consistait à vendre les enregistrements à l’accusé contre le paiement d'une somme de 50. 000$ CAD avec un acompte de 10.000$ CAD. B.R. a accepté et ils ont convenu d’un emplacement pour procéder à l’échange, au cours duquel l'accusé a été immédiatement appréhendé et mis en état d'arrestation. Lors de l’arrestation, la police a trouvé 11.000$ CAD dans sa voiture.
B.R. a plaidé coupable des deux chefs d’accusations contre lui : 1) d'avoir sciemment participé ou contribué à une activité d'une organisation criminelle dans le but d'accroître la capacité de l'organisation de faciliter ou de commettre un acte criminel et 2) d’avoir commis un abus de confiance en tant qu’agent public. Le 4 avril 2014, le juge l’a condamné à 4 ans d'emprisonnement pour chaque chef d'accusation soit 8 ans de pénitencier pour le tout (qui a été réduit à 7 ans et 3 mois en raison du temps qu’il a passé en détention préventive). B.R. aurait bénéficié d’une libération conditionnelle totale en mai 2017.

La particularité de cette affaire tient au fait que l'accusé, B. R. est un agent de renseignement, un officier censé devoir apporter protection et assurer la confidentialité des informations reçues au cours de sa profession. Ceci est d'autant plus déterminant que cette affaire est liée à des affaires de crime organisé ou de trafic de drogue.

Dans leurs réquisitions, les Procureurs de la République ont requis contre l'accusé une peine commune de 8 ans pour les deux chefs d'accusation pour lesquelles B. R. a plaidé coupable. Le juge a reconnu, en dépit de la gravité des infractions, l’existence de circonstances atténuantes qui militent en faveur de l'accusé, tels que la limitation des dommages mais aussi le châtiment moral (le remord ou la honte selon les termes du juge) qui pèse sur l'accusé ainsi que sur ses parents proches (conjointe et ami proche) qu'il aurait par ailleurs trahit.

Mais au-delà de ces appréciations du juge, il aurait aussi été intéressant que celui se prononce avec plus d'attention sur les arguments de l'accusé selon lesquels il aurait été menacé par les membres de l'organisation criminelle à laquelle les informations ont été fournies. En effet, de telles pratiques d'intimidation et de menaces sont bel et bien légion dans les modes d'opération des auteurs de crimes organisés. La protection des agents impliqué dans ces affaires ne devrait donc pas occulter ces considérations.

The particularity of this case lies in the fact that the accused, B.R., is an intelligence agent, an officer who is expected to protect and ensure the confidentiality of the information received in the course of his profession. This is all the more important because this case is linked to cases of organized crime or drug trafficking.

In their requisitions, the Public Prosecutors requested against the accused a joint sentence of 8 years for the two counts for which B.R. pleaded guilty. The judge acknowledged, despite the seriousness of the offences, the existence of attenuating circumstances which militate in favour of the accused, such as the limitation of the damages but also the moral punishment (remorse or sham in the judge’s words) on the accused and on his close relatives (his partner and his close friend) whom he allegedly betrayed.

But beyond these assessments by the judge, it would have been interesting if the judge had paid more attention to the arguments of the accused according to which he had been threatened by the members of the criminal organization to which the information has been given. Indeed, such practices are commonplace in the modus operandi of the perpetrators of organized crime. The protection of agents involved in those cases therefore should not overshadow these considerations.

    After pleading guilty on 13 March 2014, a sentencing hearing for B.R. was held on 4 April 2014. The judge accepted the joint recommendation of an 8 year prison sentence (4 years per count).

    B.R. was sentenced to 8 years' imprisonment; however, 270 days (9 months) were deducted from the sentence as time served in pre-trial detention, bringing the sentence to 7 years 3 months. The judge ordered that B.R. serve half his sentence before becoming eligible for parole.

    Avant de rendre sa décision, le juge a observé d'une part que les avocats ont soumis au Tribunal une recommandation commune sur la peine. Le juge a ensuite rappelé les principes et objectifs de détermination de la peine codifiés aux articles 718 et suivants du code criminel tout en précisant que le prononcé des peines a pour objectif essentiel de contribuer, parallèlement à d'autres initiatives de prévention du crime, au respect de la loi et au maintien d'une société juste, paisible et sûre par l'infliction de sanctions justes visant un ou plusieurs objectifs bien précis. Par ailleurs, le juge rappelle, en faisant référence à l'affaire Marchessault c. R., 41 C.R. (3d) 318 (CAQ), que la peine est proportionnelle à la gravité de l'infraction et au degré de responsabilité du délinquant.
    D'autre part, le juge tient compte de divers facteurs dans l'imposition de la peine qui militent en faveur d'une peine dissuasive et exemplaire qui aurait certainement pu être la peine maximale prévue par la loi. Il prend également en compte des facteurs qui militent en faveur de l’accusé tels que le plaidoyer de culpabilité de l’accusé à la première occasion, l’absence d’antécédents judiciaires et disciplinaires de l’accusé, ou encore la participation de l’accusé au « contrôle des dommages » causés par ses indiscrétions.
    Before rendering its decision, the judge noted, on the one hand, that the lawyers had submitted to the Tribunal a joint recommendation on the sentence. The judge, then, recalled sentencing principles and objectives codified in articles 718 and seq. of the Criminal Code while specifying that the essential objective of sentencing is to contribute, in conjunction with other initiatives of crime prevention, to respect for the law and the maintenance of a just, peaceful and safe society by imposing fair sanctions aimed at one or more specific objectives. Furthermore, the judge recalls, by referring to the case Marchessault c. R., 41 C.R. (3d)318 (CAQ), that the sentence is proportionate to the gravity of the infraction and to the degree of responsibility of the offender.
    On the other hand, the judge takes into account several factors in imposing the sentence that militate in favour of a dissuasive and exemplary sentence which could have certainly been the maximum penalty for provided by law. He further takes into account factors which militate in favour of the accused, such as the accused’s guilty plea at the earliest opportunity, the absence of judicial and disciplinary record, or the accused’s involvement in “damage control” of the damages caused by his indiscretions.
